Trade Club Terms & Conditions

OVERVIEW

We operate the Beacon Lighting Trade Club program (“Trade Club”) which is open to Beacon Lighting Trade Customers in accordance with the terms and conditions set out below (“Terms and Conditions”).

By applying to join the Trade Club, or by using your Cards, you acknowledge and agree that you have read and understood, and agree to be bound by these Terms and Conditions and by any variations to them.

We can revise these Terms and Conditions at any time without having to notify you and you must comply with the revised Terms and Conditions on revision.

1.         MEMBERSHIP                                                                                                     

1.1      Eligibility

1.1.1        Membership in the Trade Club is open to all Beacon Lighting Trade Customers.   Details as to the requirements for eligibility as a Beacon Lighting Trade Customer will be set out in the Trade Club Application Form. 

1.2      How to Join the Trade Club

1.2.1        To apply to join the Trade Club you will need to complete the Trade Club Application Form and submit the form –

  • Instore – to a Beacon Lighting sales associate at any participating Beacon Lighting Store, who will send the application to our head office;
  • By Post –  to our head office in the reply paid envelope provided; or

1.2.2        You will need to provide the Required Information, at a minimum, on the Trade Club Application Form.  Failure to provide the Required Information may  result in refusal of your application.

1.2.3        We do not require you to pay any application or joining fee.

1.2.4        We will notify you in writing either by email, SMS or post as to whether your application has been approved or refused (which is at our discretion).

1.2.5        Provided your application is approved, we will notify you in writing either by email, SMS or post of your membership details and issue you with a welcome pack which will include your Trade Club Card and five Referral Cards.  The PIN for each of the Trade Club Card and the Referral Cards can be found on the back of each Card.    The Cards and PINs will be activated and ready to use when issued.

1.2.6        If any Card is lost, damaged or stolen, contact us immediately to cancel the Card and we will issue you with a replacement Card.

1.2.7        You can only make purchases using Beacon Cash (see clause 2 below) if you have your Trade Club Card and the PIN.    Any person who has your Trade Club Card and the PIN will be able to access the Beacon Cash on your Trade Club Card.    TREAT YOUR BEACON CARD LIKE CASH.  

YOU WILL BE RESPONSIBLE FOR THE SAFEKEEPING AND USE OF THE CARDS AND ALL TRANSACTIONS USING THE CARDS WHETHER BY YOU OR OTHERS AND WHETHER AUTHORISED OR UNAUTHORISED.  THE PIN FOR EACH TRADE CLUB CARD OR REFERRAL CARD CAN BE FOUND ON THE BACK OF THE CARD.   FOR THIS REASON, ANY PERSON WHO HAS THE TRADE CLUB CARD OR REFERRAL CARD WILL BE ABLE TO USE THE CARD.   THE PIN FOR THE TRADE CLUB CARD WILL ALSO ENABLE ANY PERSON WHO HAS THE CARD TO ACCESS BEACON CASH ON THE TRADE CLUB CARD.  YOU MUST KEEP THE CARDS IN A SAFE PLACE AND ENSURE THAT THEY CAN ONLY BE ACCESSED AND/OR USED BY APPROVED EMPLOYEES OR OTHER PERSONS AUTHORISED BY YOU.   TREAT YOUR BEACON CARD LIKE CASH.   WE WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE YOU MAY INCUR OR SUFFER AS A RESULT OF THE USE OR MISUSE OF THE CARDS, PINs OR YOUR BEACON CASH.   

1.3      Trade Club Card and Referral Cards System

1.3.1        Trade Club Cards will be issued in your name and business name.    

1.3.2        The Trade Club Card and Referral Cards can be used online or at any participating Beacon Lighting Store and can be used by you and any person to whom you give the Cards or who has access to the Cards.

1.3.3        When you make purchases using your Trade Club Card, you will be entitled to, and can redeem, the Trade Club Card Benefits. 

1.3.4        When you make purchases using a Referral Card, you will be entitled to, and can redeem the Referral Card Benefits.

1.3.5        To be awarded Points for purchases at a Beacon Lighting Store or to access the Trade Club Card Benefits, including the Beacon Cash, at a Beacon Lighting Store, you will need to present the Trade Club Card at the point of sale, along with items to be purchased, to the Beacon Lighting sales associate at the participating Beacon Lighting Store.  If you do not have your Trade Club Card with you, the sales representative may, at their discretion, award you Points in relation to the transaction if you can provide them with satisfactory identification (eg. photo identification).

1.3.6        To be awarded Points for purchases online or to access the Trade Club Card Benefits, including the Beacon Cash, online, you will need to select the products you wish to purchase on the Beacon Lighting website. Once selected, add the products to your shopping cart and follow the instructions. When you proceed to the checkout you will need to enter the Trade Club Card number and PIN.

1.3.7        The Referral Cards are valid for 2 years from the date of issue and can only be used once.  

2.         BENEFITS OF MEMBERSHIP

2.1      Points System 

2.1.1        The Trade Club Card and Referral Cards will all be linked to your Trade Club Account. 

2.1.2        You will be awarded Points for purchases made using your Trade Club Card and Referral Cards. 

2.1.3        Points will expire 2 years from the date of issue. 

2.1.4        The Rate of Points to which you are entitled will be determined by us and may be varied from time to time.

2.1.5        We will notify you of the Rate of Points applicable to you on joining the Trade Club in the Trade Club Application Form.

2.1.6        We will send you periodically (eg. monthly) by email, or post, a statement including details as to purchases made using your Trade Club Card and your Referral Cards, your Points balance, any variation to the Rate of Points, your redemption of Points and any variation to the Redemption of Points System together with newsletters, catalogues and other promotional material.

2.1.7        You can check your Points balance and Points expiry date(s) and Beacon Cash balance and the Beacon Cash expiry date or details of transactions on your Cards at any time by calling us on 03 8561 1502.  For Points balance or Beacon Cash balance enquiries you will need your Trade Club Card number and PIN. 

2.2      Redemption of Points 

2.2.1        The Redemption of Points System will be determined by us and may be varied from time to time.

2.2.2        We will notify you of the Redemption of Points System applicable to you on joining the Trade Club in the Trade Club Application Form.

2.2.3        Points will be redeemed in exchange for Beacon Cash.

2.2.4        Beacon Cash of $100 will be issued automatically onto your Trade Club Card each time your Trade Club Account reaches the Qualifying Amount.

2.2.5        We will notify you by email and/or SMS when we issue Beacon Cash onto your Trade Club Card.

2.2.6        Except as set out in clause 2.1.3, your Points will accumulate until you have enough Points to reach the Qualifying Amount.   For example, if we issue $100  onto your Trade Club Card, you will only receive the next $100 on your Trade Club Card when you reach the next Qualifying Amount. 

2.2.7        Beacon Cash will expire 12 months after being issued to you on your Trade Club Card, unless more Beacon Cash is issued to you on your Trade Club Card within the 12 months, in which case the 12 months will start on the last date on which Beacon Cash was issued to you on your Trade Club Card.  Beacon Cash cannot be used after the expiration date.

2.3      Use of Beacon Cash

2.3.1        In order to use the Beacon Cash on your Trade Club Card for purchases you will need your Trade Club Card and your PIN.     

2.3.2        Beacon Cash can be used online or at any participating Beacon Lighting Store. Beacon Cash can be used to purchase any products, including Beacon Lighting Gift Cards sold online or in participating Beacon Lighting Stores, with the exception of excluded product lines as determined by us from time to time.

2.3.3        Beacon Cash may be used in conjunction with other promotions and rewards, subject always to our sole discretion or the discretion of the Beacon Lighting Store.

2.3.4        Points will not be awarded for purchases using Beacon Cash.  For example, if you purchase products to the value of $300 using $100 of Beacon Cash, then Points will only be awarded on $200 of the purchases. 

2.3.5        To use your Beacon Cash at a Beacon Lighting Store, take your Trade Club Card to the participating Beacon Lighting Store of your choice. Select the products you wish to purchase and then give the products together with your Trade Club Card and PIN to a Beacon Lighting sales associate. The sales associate will then use your Trade Club Card to pay for the Price of the products by scanning your Trade Club Card and entering your PIN into the store point of sale system – see below if the value of the products exceeds the Card Value.  By giving your Trade Club Card and PIN to the sales representative you authorise them to use your Trade Club Card to pay for the products selected and to deduct the Price of those products from your Trade Club Card.

2.3.6        To use your Beacon Cash online, select the products you wish to purchase on the Beacon Lighting website.   Once selected, add the products to your shopping cart and follow the instructions. When you proceed to the checkout you will need to enter your Trade Club Card number and PIN.    The Beacon Cash on your Trade Club Card will then be used to pay for the Price of the products – see below if the value of the products exceeds the Card Value.  By entering your Trade Club Card number and PIN you authorise us to use your Trade Club Card to pay for the products selected and to deduct the Price of those products from your Trade Club Card.

2.3.7        The Card Value will then be reduced by the Price of the products. 

2.3.8        If the value of the products you wish to purchase exceeds the Card Value, then you will need to pay the additional amount owing by cash, EFTPOS or credit card (whichever applies).

2.3.9        Products paid for, in full or part, using your Beacon Cash may be exchanged or returned, subject to our exchange and returns policy which is available at www.beaconlighting.com.au. If you return the products paid for with your Beacon Cash, the refund will be issued by way of a credit of Beacon Cash onto your Trade Club Card, not cash.

2.3.10      Purchases of products using your Beacon Cash are covered by our ‘Returns Policy’ and ‘Warranty’. 

3.         CARDHOLDER SERVICE AND ENQUIRIES

Please contact us should you have any queries regarding the Trade Club, your Cards or your Beacon Cash or in the event that any of your Cards are lost, damaged or stolen or your PINs are disclosed, lost or stolen.

4.         TERMINATION OF YOUR  TRADE CLUB MEMBERSHIP 

4.1      Termination by You

You can terminate your Trade Club Membership at any time by notifying us in writing. All Trade Club Card Benefits and Referral Card Benefits accumulated or available as at the termination date will be forfeited.  

4.2      Termination by Us

We reserve the right any time without notice and in our absolute discretion to terminate the Trade Club program, your Trade Club Membership and/or vary the Rate of Points, Redemption of Points System and/or these Terms and Conditions. Neither us or any of the Beacon Lighting Stores accept any liability for loss or damage associated with the terminations or variations referred to in this clause 4.2.

5.         PRIVACY POLICY

6.         COMPLAINTS


  1. If you have any complaints about products purchased using your Cards please contact the Beacon Lighting Store from which you purchased the products or for online purchases visit www.beaconlighting.com.au/online-shopping/returns-policy and follow the instructions.

Please report any faults or problems with your Cards to Beacon Lighting Head Office on 03 8561 1502.  

7.         EXCLUSION OF LIABILITY

To the extent permitted by law, we exclude all liability (including negligence) for any personal injury, loss or damage (including loss of opportunity), whether direct or indirect, special or consequential arising in any way out of the Trade Club.

8.         GENERAL

8.1      The termination of your Trade Club Membership will not affect any provision contained in these Terms and Conditions of Sale which expressly or by implication is to become operative or continue to operate after your Trade Club Membership is terminated. 

8.2      No agent, employee or representative of ours will have any authority whatsoever to bind us to any affirmation, representation, warranty or condition concerning the Trade Club and these Terms and Conditions of Sale unless such affirmation, representation, warranty or condition is specifically included in writing within these Terms and Conditions of Sale.

8.3      All notices, requests, consents, approvals or other communications (Communications) given under these Terms and Conditions must be in writing and may be signed and delivered by a party to the other party personally, by prepaid post, email or facsimile transmission to the party’s street or postal address, email address or facsimile number as notified to the other party and will be considered to have been received if:

  • delivered personally, on delivery;
  • sent by prepaid post, on the following Business Day, notwithstanding that it may subsequently be returned through the Post Office unclaimed;
  • sent by facsimile transmission, on production of a transmission control report indicating transmission without error; or 
  • sent by email, on receipt by the sender of confirmation on its computer that the message has been delivered.

8.4      These Terms and Conditions are governed by the laws in force in the State of Victoria and the parties submit to the jurisdiction of the Courts of that State and Courts competent to hear appeals from those Courts.

8.5      The provisions of these Terms and Conditions of Sale will be separate and severable from each other to the extent that if any provision or provisions are considered to be inoperative then the remaining provision or provisions will be binding on and enforceable by the parties.

9.         DEFINITIONS

In these Terms and Conditions unless the context otherwise requires:

Beacon Cash                                       means the cash credit issued by us onto your Trade Club Card once you have enough Points to reach the Qualifying Amount and which can be used online or at any participating Beacon Lighting Store.

Beacon Lighting Gift Card                 means a Beacon Lighting gift card issued by us or any participating Beacon Lighting Store in accordance with the Beacon Lighting gift card terms and conditions as set out on the Beacon Lighting website - www.beaconlighting.com.au/giftcards.

Beacon Lighting Store or

Beacon Lighting Stores                     means an Australian Beacon Lighting store or stores participating in the Trade Club operated by us, details of which are set out on the Beacon Lighting website - www.beaconlighting.com.au.

Beacon Lighting Trade Customer    means any person determined by us according to our eligibility criteria to be a trade customer, as varied from time to time by us at our discretion.

Card or Cards                                      means the actual Trade Club Card and/or Referral Card or Referral Cards issued by us to you.

Card Value                                           means the value of the Beacon Cash issued by us on your Trade Club Card or remaining at the time of purchase of any products.

 

GST                                                       has the same meaning as that word is given in the A New Tax System (Goods and Services Tax) Act 1999 (as amended).

PIN                                                        means thesecurity access code featured on the back of your Trade Club Card or a Referral Card, to enable the Card to be used.

 

Points                                                   means the points that you receive for purchases of products online or in the Beacon Lighting Stores using the Trade Club Card and the Referral Cards, in accordance with these Terms and Conditions.  

Price                                                     in relation to the purchase by you of products means the price of the products including GST and which may include Beacon Lighting Gift Cards.

Qualifying Amount                              means the amount of Points you must accumulate in order for us to issue you with Beacon Cash.  In order to qualify to receive Beacon Cash you must have accumulated a designated number of Points in total (“Qualifying Amount”). The Qualifying Amount will be determined by us and you will be informed as to the current Qualifying Amount at the time you complete the  Trade Club Application Form. The Qualifying Amount may be varied by us from time to time.

Rate of Points                                      means the amount of Points received by you per dollar spent using your Trade Club Card or Referral Cards.

Redemption of Points System           means the system established and maintained by us for the redemption of Points in exchange for Beacon Cash.

Referral Card                                       means any actual Referral Card issued by us to you in accordance with and for use as set out in these Terms and Conditions.

Referral Card Benefits                        means the benefits available to any holder of a Referral Card, as varied and notified by us by email, SMS or post from time to time.

Required Information                         means the minimum information that you must supply in the Trade Club Application Form including your name, address, gender, date of birth, phone number, email address, business name and ABN.

Terms and Conditions                        means these Terms and Conditions and any terms and conditions set out on the back of your Trade Club Cards, as revised by us from time to time.

Trade Club                                           means the Beacon Lighting Trade Club program operated by us and participating Beacon Lighting Stores.

Trade Club Account                           means the account established by us in connection with your Trade Club Membership into which we will deposit Beacon Cash, which Beacon Cash may be used by you to pay for products purchased online or in participating Beacon Lighting Stores in accordance with these Terms and Conditions.

 

Trade Club Application Form            means the form that you must complete in order to become a Trade Club Member and receive the Trade Club Cards and Trade Club Card Benefits and, where applicable, Referral Cards and Referral Card Benefits.

 

Trade Club Card                                  means the actual Trade Club Card issued by us to you in accordance with and for use as set out in these Terms and Conditions.

Trade Club Card Benefits                  means the Points and other benefits available to you as the holder of the Trade Club Card, as varied and notified by us by email, SMS or post from time to time. 

Trade Club Membership                    means a membership of the Trade Club, on these Terms and Conditions.

You or your                                          is a reference to the person who applies for your Trade Club Membership and, where applicable, includes any person authorised by you to use the Cards.

We or us or our                                   is a reference to Brightlite Nominees ABN 13 322 464 749 of 5 Bastow Place, Mulgrave, Victoria 3170 and, where applicable, includes Beacon Lighting franchisees who own and operate any participating Beacon Lighting Stores and our employees and assignees.

10.      INTERPRETATION

In these Terms and Conditions unless the context otherwise requires:

  • any agreement, warranty, representation or obligation which binds or benefits 2 or more persons, binds or benefits those persons jointly and severally;
  • headings and the table of contents appear for convenience only and do not form part of this Agreement.
  • a reference to:
  • the singular includes the plural and vice versa;
  • a person includes an individual, a body corporate and a government and, where applicable, their servants, agents and employees;
  • “including” in this Agreement means “including without limitation”;
  • any thing or amount is a reference to the whole and each part of it;
  • “$” or “dollars” is a reference to the lawful currency of Australia;
  • examples are descriptive only and are not intended to be exhaustive.
